These Terms of Service (“Terms”) form a binding agreement between you and Paycheck (“Paycheck,” “we,” “us,” or “our”) governing access to and use of our websites, mobile deposit flows, APIs, operator consoles, and related services (collectively, the “Service”).
By creating an account, connecting a wallet, scanning a check, requesting manual review, or otherwise using the Service, you agree to these Terms and to our Privacy Policy and Disclosures. If you do not agree, do not use the Service.
Paycheck is a software platform. We are not a bank, savings association, credit union, or FDIC-insured institution. We do not ourselves take consumer demand deposits. Check collection, image cash letter presentment, and fiat settlement are performed by partner financial institutions and processors under applicable banking and payments rules, including Check 21 image exchange where available.
You must be legally able to enter this agreement in your jurisdiction. Where required, you must complete identity verification, sanctions screening, and any other know-your-customer or anti-money-laundering procedures we or our partners request.
Some features require a connected Solana wallet. You are solely responsible for safeguarding wallet credentials, seed phrases, and device access. Paycheck never asks for your seed phrase.
You are responsible for the accuracy of any destination address you provide. Blockchain transfers are typically irreversible after network confirmation. We are not liable for losses caused by wrong addresses, compromised wallets, or third-party wallet software.
Submitting check images, OCR results, or a deposit request does not guarantee acceptance, clearance, or crypto payout. We and our partners may reject items for quality, fraud, duplicate presentment, risk, collectability, or policy reasons.
Low-confidence scans may be eligible for a paid manual review path. Flat review fees, when charged, are quoted in USD and payable in SOL at a live spot rate. Payment must confirm on-chain to our designated fee wallet before a review request is queued.
Automatic deposit fees, when applicable, are disclosed in Pricing and may include check processing, conversion, and network costs. Fees are deducted before payout unless a document says otherwise.
The Service, including software, branding, documentation, and design, is owned by Paycheck or its licensors. You receive a limited, revocable, non-exclusive license to use the Service as offered. You may not copy, reverse engineer, or resell the Service except as allowed by law or a separate written agreement.
Portions of the Service may run in demonstration, sandbox, or beta mode. Simulated clearance states, example ledger entries, and mock risk scores are not real bank settlement. Do not treat demo balances as spendable funds. Production banking features require active partner integrations and applicable licenses.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, or that deposits will clear within any particular time.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAYCHECK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) FEES YOU PAID TO PAYCHECK FOR THE TRANSACTION GIVING RISE TO THE CLAIM IN THE PRIOR THREE MONTHS OR (B) ONE HUNDRED U.S. DOLLARS.
You will indemnify and hold harmless Paycheck and its partners from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service, your check presentments, your wallet activity, or your violation of these Terms or law.
We may modify these Terms by posting an updated version. Continued use after the effective date constitutes acceptance. We may suspend or terminate access immediately for risk, abuse, or legal reasons. Sections that by nature should survive termination will survive.
These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules, unless a mandatory consumer protection law in your residence requires otherwise. Courts in Delaware will have exclusive jurisdiction for disputes that are not subject to a required alternative forum.
